LIV Golf to determine future of league by end of October

Legal representatives for LIV Golf confirm a decision on the league's potential restructuring or closure is expected by the end of this month.

LIV Golf to determine future of league by end of October

LIV Golf is expected to reach a definitive decision regarding its future by the end of October, according to legal counsel representing the tour in federal bankruptcy proceedings. The announcement follows ongoing restructuring efforts aimed at launching a potential second iteration of the circuit, referred to as LIV 2.0.

During a hearing in the U.S. Bankruptcy Court of New Jersey on Wednesday, attorney Robert Fitzgerald informed Judge Michael B. Kaplan that the organisation will soon determine whether it will cease operations or proceed with its planned business model. The timeline remains a critical factor for the league's stakeholders.

The legal proceedings have been complicated by recent developments regarding the DP World Tour. CEO Guy Kinnings confirmed earlier this week that his circuit will not grant conditional membership to golfers participating in LIV 2.0 for the 2027 season, a departure from policies in previous years.

Fitzgerald expressed significant concern regarding the DP World Tour's stance, describing the policy as a clear attempt to interfere with LIV Golf's restructuring process. He argued that the timing of the announcement raises serious anti-competitive questions regarding the treatment of professional players.

Judge Kaplan acknowledged the concerns raised by the league's legal team, noting that the comments made by the DP World Tour regarding player eligibility warrant further attention. The court has been monitoring the situation as it relates to the broader golf ecosystem.

LIV Golf maintains that its founding principles are rooted in player freedom and the ability for athletes to compete across various circuits. Fitzgerald stated that the league continues to advocate for greater flexibility for the best players to participate in multiple events globally.

In a significant move during Wednesday's hearing, Judge Kaplan approved a motion allowing LIV Golf to reject the current contracts of 19 golfers. The league stated that these existing agreements do not align with the proposed compensation structure for the upcoming LIV 2.0 model.

The list of players affected by the contract rejection includes high-profile names such as Bryson DeChambeau, Dustin Johnson, Cameron Smith, and Bubba Watson. LIV Golf officials indicated that this step is essential for negotiating new, restructured deals with these athletes.

The court also granted approval for an amended restructuring support agreement. Under this plan, BC Partners is set to provide up to $300 million in financing for the new league, which includes an initial $4 million loan to maintain operations during the Chapter 11 process.

The proposed equity distribution for LIV 2.0 outlines a structure where golfers would hold 52.5% of the league's equity. BC Partners and potential minority investors would hold 45%, while management would retain the remaining 2.5% stake in the organisation.

The restructuring comes amid reports of several prominent players opting not to participate in the future iteration of the tour. Legal representatives for two-time major champion Jon Rahm confirmed last week that he will not be involved in the new league.

Other players, including David Puig and Abraham Ancer, have reportedly chosen to walk away from the tour. Additionally, golfers such as Marc Leishman and Harold Varner III had previously requested releases from their contracts to explore alternative playing opportunities.

Attorneys representing an ad hoc group of LIV golfers, including DeChambeau, Johnson, Watson, and Lee Westwood, attended the bankruptcy hearing on Wednesday. Their presence highlights the ongoing negotiations between the league and its contracted players.

The DP World Tour's decision to deny 2027 membership to LIV 2.0 participants creates a significant hurdle for players who previously held dual status. This policy previously allowed golfers like Rahm and Tyrrell Hatton to remain eligible for the European Ryder Cup team.

Players are required to submit their applications for DP World Tour membership by November 16. The tightening of these regulations places additional pressure on golfers currently weighing their future options within the professional golf landscape.

LIV Golf has consistently argued that competing leagues have sought to box out market participants through restrictive policies. The league maintains that its focus remains on building a player-centric model despite the current legal and financial challenges.

The bankruptcy process continues to serve as the primary venue for these disputes. Judge Kaplan remains the presiding authority over the restructuring support agreement and the various motions filed by LIV Golf's legal team.

As the October 31 deadline approaches, the golf world awaits clarity on whether the tour will successfully transition into its second phase. The outcome will likely have lasting implications for the professional game and the future of player mobility.

The financial backing from BC Partners is intended to provide the necessary stability for the transition. Whether this investment will be sufficient to overcome the current regulatory and contractual obstacles remains the central question for the league's future.

Further updates are expected from the court as the restructuring process continues. The league's ability to secure commitments from its top-tier players will be a decisive factor in determining the viability of the LIV 2.0 project.
